2         Notice         

For reasons of readability, the male form (client) was chosen in the text, the information refers nevertheless to members of all genders.          

3         Scope of application

The latest version of the general terms and conditions always applies. The client accepts the following general terms and conditions in the event of any use of services or facilities of Stibahlife GmbH, Sunnestrahl 1, 8834 Schindellegi.

4         Liability, house rules and regulations

The use of any service or facility of Stibahlife GmbH outdoor, online, at the client’s home or at any chosen location, i.e. its premises, training equipment, furniture as well as the participation in trainings, consultations, treatments, visits and events is entirely at the client’s own risk. The client is responsible for his own property and safety. Stibahlife GmbH is not liable for any loss, injury, illness, death nor other damages of the client.

The client is liable for any loss or damage of the premises, training equipment and furniture of

Stibahlife GmbH. All training equipment and furniture on loan must always be returned to Stibahlife GmbH and any loss or damage must be immediately reported and replaced or repaired at full cost.

The client confirms to follow the instructions of Stibahlife GmbH, the valid house rules, hygiene and protective measures as well as the general terms and conditions. The disregard can lead to a warning or abolition of the right of any use of services or facilities of Stibahlife GmbH. In that case there is no right for a refund for already received, current or outstanding services.

5        Health condition

By the use of any service or facility of Stibahlife GmbH the client confirms that no physical, medical or health concerns, intolerances, physical limitations or acute injuries are known.

The Stibahlife GmbH is not liable for any health, medical and physical concerns, including those unknown to the client, in the event of an accident, illness, injury or death. In borderline cases the client’s physical, medical and health condition should be examined by a doctor. If the client renounced on it, the use of the services and facilities is on the client’s own risk, full responsibility and liability.

The client is liable for the personal insurance against accidents, illnesses, injuries or similar which can occur within any use of services or facilities of Stibahlife GmbH.

For the purchase of certain services of Stibahlife GmbH a health questionnaire has to be additionally filled out by the client.

6         Membership

A concluded membership at Stibahlife GmbH is personal and nontransferable – unless the contract provides otherwise.     

Stibahlife GmbH reserves the right to limit the number of members and participants.

7         Use and operation

The services and facilities of Stibahlife GmbH can be used according the guidelines and subscription type.

Stibahlife GmbH reserves the right to modify the location, hours of operation, furniture and offers.

8        Subscriptions, contract duration and dates

The duration of the contract depends on the respective type of subscription or individual service concluded.

The cancellation deadline of an appointment is in general 24h before the start of the appointment. Stibahlife GmbH reserves the right to charge the client a canceled appointment at full cost.

The respective subscription or individual service expires automatically and can be extended as required, unless it is a special offer.

In the event of a valid reason the membership can be interrupted, whereby no requirement insists. 

Non-use of the services and facilities of Stibahlife GmbH does not justify a reduction or refund of the subscription fee / paid individual service. 

Withdrawal from the contract and a corresponding refund can only be granted in hardship cases such as a long-term illness or accident, whereby no requirement insists. 

If Stibahlife GmbH cannot fulfil its obligations due to circumstances uncontrollable (fire, earthquake, water, epidemics, pandemics, state restrictions or similar), the client cannot claim for compensation of damages or a refund.       

The services can change at any time, whereby no requirement for a refund or prolongation of the subscription / paid individual service can be derived. 

9      Payment and default of payment

The membership fee or payment for individual services are payable at the time of the conclusion of the contract respectively contract prolongation within the agreed payment deadline – unless the contract provides otherwise. All prices are in Swiss Francs (CHF), including VAT. and based on the actual price list of Stibahlife GmbH. Without received payment there is no access authorization and requirement to the use of services.

In the event of a default of payment, Stibahlife GmbH reserves the right to invoice the client for default costs, if the costs were culpably caused by the client. This includes in addition to the default interest at the statutory rate also the costs of an appropriate prosecution, in particular reminder and collection fees, court and legal costs.

10      Changes of the general terms and conditions / house rules

The client explicitly acknowledges that the general terms and conditions as well as the house rules are subject to change and that these are brought to his attention in an appropriate form. The client cannot derive any rights from a change of the general terms and conditions or house rules.

11      Data protection

The handling of personal data takes place in accordance with the data protection declaration of Stibahlife GmbH. With the conclusion of the membership contract or the purchase of individual services, the client confirms that he has read and taken note of the data protection declaration and the handling of personal data described therein.

12      Applicable law and place of jurisdiction

This contract replaces all previous written or verbal agreements between the client and Stibahlife GmbH. The general terms and conditions and all related ordinances are exclusively governed by Swiss Law. The county Hoefe is the place of jurisdiction for all conflicts which could result from this contract.
